1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and IMAGIMATIC LLC (doing business as "JokeText") concerning your use of the JokeText service.

By using JokeText, you agree to these Terms. If you don't agree, don't use the service.

2. Eligibility

To use JokeText, you must:

• Be at least 18 years old
• Have the legal capacity to enter into a binding contract
• Provide accurate account information
• Maintain the security of your account

You are responsible for all activities under your account. While you may create joke profiles for children or family members, you as the adult subscriber are responsible for all content and usage.

3. Service Description

JokeText is a subscription service that delivers personalized, AI-generated jokes to your email or phone (SMS for paid plans). You control the schedule, frequency, and delivery method.

What We Provide:

• AI-generated jokes personalized to your preferences
• User-controlled delivery schedules
• Multiple joke profiles per account
• Email delivery (all plans) and SMS delivery (paid plans)
• Joke rating and history

Service Limitations:

• We don't guarantee every joke will be funny (humor is subjective)
• We don't guarantee 100% uptime or uninterrupted service
• We're not responsible for carrier delays or delivery failures
• AI-generated content may occasionally produce unexpected results

4. Subscription & Billing

Free Trial

New users get a 7-day free trial with full access to paid features. A credit card is required to start your trial. If you don't cancel before the trial ends, you'll automatically be charged for your selected plan.

Billing

• All payments processed securely through Stripe
• Subscriptions auto-renew monthly or annually based on your plan
• You'll be charged unless you cancel before renewal
• All fees are in USD

Cancellation & Refunds

You can cancel anytime through your account settings. Upon cancellation:

• You keep access until the end of your current billing period
• No charges for future periods
• Subscriptions are non-refundable (no refunds for partial periods)
• Exception: Cancel during your free trial to avoid charges

Price Changes

We may change subscription prices with 30 days' notice via email. Changes won't affect your current billing period.

5. SMS Messaging

SMS Delivery (Paid Plans Only)

To enable SMS delivery, you must verify your phone number and explicitly consent to receive messages. One phone number per account.

What You'll Receive

By enabling SMS, you consent to receive:

• Verification code (one-time during setup)
• Scheduled jokes (frequency based on your settings)
• Rare account notifications (critical issues only)

Message Frequency & Cost

• Frequency: Completely user-controlled - you choose when and how often
• Cost: Standard message and data rates may apply from your carrier
• Carrier charges: Not included in your JokeText subscription

Opt-Out Options

Stop SMS delivery by:

• Reply STOP to any message (immediate effect)
• Toggle SMS off in account settings
• Remove your phone number from your account
• Delete your account

Keywords: STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT (to stop) | START, UNSTOP (to resume) | HELP, INFO (for support)

7. Acceptable Use

You May:

• Use JokeText for personal entertainment
• Share jokes with friends and family
• Post jokes on personal social media
• Tell jokes verbally in personal settings

You May NOT:

• Use jokes for commercial purposes (selling, licensing, advertising)
• Compile jokes into paid products (books, courses, etc.)
• Share your account with others or create multiple accounts
• Use automated tools or bots to access the service
• Reverse engineer or attempt to hack the service
• Use the service for any illegal purpose

8. Disclaimers & Liability

Service Provided "AS IS"

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We don't guarantee that the service will be uninterrupted, error-free, or that defects will be corrected.

Limitation of Liability

To the maximum extent permitted by law, JokeText is NOT liable for:

• Offensive, inappropriate, or harmful AI-generated content
• Personal or professional consequences from sharing jokes
• Service interruptions or delivery failures
• Carrier delays or SMS delivery issues
• Loss of data, profits, or business opportunities
• Any indirect, incidental, or consequential damages

9. Termination

You Can Terminate

Cancel your subscription anytime through account settings or by emailing hello@joketext.com. You keep access until the end of your billing period.

We Can Terminate

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity or abuse the service
• Have repeated payment failures

Effect of Termination

Upon termination, your access ends and your data will be deleted per our Privacy Policy. You remain responsible for all charges incurred before termination. No refunds for remaining time.

10. Changes & Contact

Changes to These Terms

We may update these Terms from time to time. We'll notify you of material changes via email or through the service. Your continued use after changes take effect means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of Delaware, USA. Any disputes will be resolved under Delaware law.
